1. Description of Service

PostPilot is an automated content scheduling and management platform. The service allows you to create, schedule, and publish photo slideshow content to your connected social media accounts. PostPilot integrates with various third-party services to provide content generation and scheduling capabilities.

2. User Accounts and Security

You are responsible for maintaining the confidentiality of your PostPilot account credentials and connected social media account connections. You agree to notify us immediately of any unauthorized access to your account. We recommend keeping your device and browser secure and logging out after each session.

3. User Content and Ownership

You retain all ownership rights to the content you create and publish through PostPilot. By using our service, you grant PostPilot a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the service. This license terminates when you delete your content or close your account.

You represent and warrant that you own or have the necessary rights to use all content you upload, and that your content does not violate any third-party rights or applicable laws.

4. Intellectual Property

The PostPilot application, including its source code, design, and functionality, is protected by intellectual property rights. You may not copy, modify, distribute, or reverse engineer any part of the application. All trademarks and logos are the property of their respective owners.

5. Content and Usage

You are solely responsible for the content you create and publish through PostPilot. You agree to comply with the connected platforms' Community Guidelines and Terms of Service. We reserve the right to suspend or terminate accounts that violate platform policies or engage in prohibited activities, including but not limited to:

  • Publishing spam, misleading, or harmful content
  • Violating intellectual property rights
  • Using the service for illegal activities
  • Attempting to circumvent rate limits or platform restrictions

6. Age Requirement

You must be at least 13 years of age to use PostPilot. If you are under 18, you must have parental or guardian consent to use the service. By using PostPilot, you represent and warrant that you meet these age requirements.

7. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of PostPilot at any time without prior notice. We may update features, change pricing, or adjust service capabilities as needed. While we strive to maintain service quality, we do not guarantee uninterrupted availability.

8. Third-Party Services

PostPilot integrates with third-party services including social media platform APIs, AI content generation services, stock image providers, and data storage services. These services have their own terms and privacy policies. We are not responsible for the practices or availability of third-party services.

9. Connectivity and Requirements

PostPilot requires an active internet connection to function. You are responsible for any data charges or connectivity costs. We are not liable for service disruptions caused by network issues, browser compatibility, or device limitations.

10. Limitation of Liability

PostPilot is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost revenue, data loss, or account suspensions resulting from use of the service. Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is less. You use PostPilot at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless PostPilot, its owner, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from: (a) your use of the service; (b) your content; (c) your violation of these terms; or (d) your violation of any third-party rights.

12. Termination

We reserve the right to terminate or suspend access to PostPilot at any time for any reason, including violation of these terms. You may also terminate your account at any time by contacting us.

Upon termination: (a) your right to use the service will immediately cease; (b) we will delete your account data within 30 days unless legally required to retain it; (c) you remain liable for any obligations incurred prior to termination.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of PostPilot shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved in the appropriate courts, and you consent to the jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
